Freedom of Information Act

The Freedom of Information Act (FOI) which came into force on January 01 2005, establishes the right to information held by the public sector.

The main features of the act are:

  • A right of wide general access to information subject to clearly defined exemptions and conditions
  • A right to consider discretionary disclosure in the public interest even when an exemption applies
  • A duty to publish information
  • Powers of enforcement through an independant commissioner and an information tribunal
